Über dem Verfassungskonvent von Philadelphia schwebte – wie erwähnt – stetig der Geist des Kompromisses. Hinsichtlich der Amendmentregelung wurde der Wille zur „aurea mediocritas“ schließlich exemplarisch umgesetzt, indem man einen Mittelweg fand zwischen einer „fließenden“, leicht zu ändernden Verfassung, die beispielsweise keinerlei Schutz vor unerwünschtem politischen Wandel geboten hätte, und einer allzu rigiden Ordnung ohne jegliche Möglichkeit zur gelegentlich notwendigen Neuorientierung. Art. V übernahm hierbei eine bedeutsame Rolle.

So konnten noch die Articles of Confederation nicht ohne die Zustimmung der Legislaturen [Fn. 618, vgl. Fragment 224 101-107 ] aller Einzelstaaten geändert werden - ein System, das sich nach überwiegender Meinung als unpraktikables Mittel zu Stillstand und potentieller Separation instrumentalisieren ließ. When the Constitution’s framers met in Philadelphia, they decided to steer a middle course between establishing a constitution that was so fluid as to provide no protection against the vicissitudes of ordinary politics and one that was so rigid as to provide no mechanism for orderly change. An important part of the compromise they fashioned was embodied in Article V.

The old Articles of Confederation could not be amended without the consent of every state — a system that was widely recognized as impractical, producing stalemate and division.

Der Begriff "legislatures" in Artikel V bezeichnet "deliberative, representative bodies of the type which in 1789 exercised the legislative power in the several States.
